Licensing Act 2003 Statement of Principles Consultation
As a result of Local Government Reorganisation the new Unitary Authority of Cheshire West & Chester will be created from 1st April 2009.
The Licensing Authorities of each former Council will be replaced by a single Licensing Authority and as a result, a new Statement of Licensing Policy has been drafted for consultation. The requirement under section 5 of the Licensing Act 2003 is that the Licensing Authority must determine its Policy with regard to the exercise of its licensing functions for a three year period. This new Policy will, following consultation and approval by the new Council, take effect from 1st April 2009 and as provided for in the legislation will be reviewed again in January 2011.
Before determining its Policy a Licensing Authority must consult with persons representing businesses and residents and with Responsible Authorities for the new licensing area. Members of the public and businesses are invited to consider the document and send comments to:
