Shelters
From July 1st2007 smoking was banned in public places and workplaces.
It was banned in all premises that are enclosed or substantially enclosed.
Enclosed - Premises will be considered to be enclosed if they have a ceiling or roof and, except for doors, windows or passageways, are wholly enclosed, whether on a permanent or temporary basis. Tents, marquees or similar will also be classified as enclosed premises if they fall within this definition.
Substantially enclosed - means a room with a roof or ceiling, of any material and where the walls are 50% or more complete.
A wall with an opening door or window will count as a complete wall.
Across the page are three smoking shelters currently being sold by British companies.
Only one would comply with the new legislation, the middle one.
When siting a shelter remember you will responsible for the litter and noise generated from it. So a bin for the tab ends would be a good idea and think of your neighbours.
If you are thinking of erecting a smoking shelter on your premises you should contact the planning department of Chester City Council as planning permission might well be needed.
