Food Safety Enforcement Policy
The council will strive to ensure that food and drink intended for sale for human consumption, which is produced, stored, distributed, handled or consumed within the district, is without risk to the health or safety of the consumer to secure the effective and efficient compliance with the provisions of The Food Safety Act 1990 and associated legislation.
The council will ensure that the planning, management and delivery of its food law enforcement service is in accordance with the requirements of The Standard in the Food Standards Agency Framework Agreement on food law enforcement. A documented Food Safety Enforcement Policy and appropriate policies and procedures will be drawn up, implemented and reviewed. Enforcement decisions taken by all authorised officers should abide by this policy. Any departure from the policy, based on exceptional or specific local circumstances, must be capable of being justified and be fully considered in consultation with the Food Safety Manager with advice if necessary from the Legal Section.
The council has resolved that authorisation to prosecute has been delegated by Committee to the Community Services Manager. In practice the decision to prosecute will be made by the Community Services Manager, in consultation with the Food Safety Manager and Senior Environmental Health Officer/Environmental Health Officers of the Food Team and the Legal Section.
In accordance with the requirements of the Food Standards Agency Framework Agreement on food law enforcement, the Food Safety Manager has been nominated as Lead Officer for food hygiene and safety matters.
