Demolition

Demolition operations can be quite diverse, they range from a demolition of a residential two storey house, a small industrial or commercial building up to more complex projects where each stage of the dismantling process requires careful planning. Pre-planning of the proposed demolition is vital to avoid any problems or hazards which may arise.

During demolition of a building inevitably there will be dust and noise, unfortunately these temporary nuisances cannot be avoided only minimised and there are obligations (some statutory) placed upon the contractor to do so.

Health risks, nuisance and environmental damage need to be avoided and the rights of the general public have to be protected.

Under Sections 80, 81, 82 and 83 of the Building Act 1984 we regulate to some degree the intended demolition site and the contractor. The Act imposes a number of duties on the person who intends to carry out the demolition work.

These duties are:

  • To give written notice to the Building Consultancy Section of the intended demolition, specifying the building, its address and the extent of the demolition works.
  • The demolition company must not commence demolition until:
  1. The Council has given either the demolition contractor, builder or developer written notification of the conditions within which the work can be carried out or,
  2. A period of six weeks has elapsed from the date that the Demolition Notice was issued by the Council.
